Regulating activities involving autonomous and agentic AI presents significant challenges. Traditional regulatory assumptions regarding regulatee knowledge and control no longer hold, as much of that resides elsewhere in the AI supply chain, necessitating its inclusion in regulatory scope.
Governance systems for autonomous AI cannot simply replicate existing models; a fresh approach is required. Retrospective supervisory oversight becomes ineffective as a risk management tool, and AI autonomy introduces new systemic risks that demand innovative solutions.
This paper investigates four regulatory systems: UK regulation of content platforms, data protection, UK financial services, and the EU AI Act's cross-sectoral framework. It analyzes the challenges posed by autonomous and agentic AI and proposes potential solutions regulators might adopt. These solutions would transform regulation from a reactive process to an active one, aiding adaptation to the challenges of AI autonomy.
